Updates and Upcoming Proposed Crematorium P&Z Hearing Dates, July 15 and July 28, 2015
Upcoming Bethel Planning & Zoning (P&Z) hearing dates for the proposed crematorium are as follows (see below), but please check back often as meeting dates seem to be changing rapidly lately! All meetings listed below are at 7:00 p.m. in EITHER the Denis Riordan Room D ~OR~ the General Purpose Room, of the Clifford J. Hurgin Municipal Center at 1 School Street, Bethel, CT, unless otherwise noted. Check schedule below and please check the schedule on the day of the meeting for any changes.

The Bethel Planning & Zoning Commission will hear an application by CT Coining Inc., a request for an amendment to the Town of Bethel Zoning Regulations. Amend Section 4.3.C.10a, Eliminate Crematory Facility.
The crematorium issue began almost two years ago and is still ongoing. As the proposed crematorium controversy continues, we now have three attorneys involved, three applications pending, a lawsuit pending, and two upcoming P&Z hearings in July. We also have the crematorium moratorium in place for a year as well as the amended zoning regulation that does not presently allow a crematorium in Bethel’s IP Zone, which includes Clarke Business Park.
Two applications are from the crematorium applicant B. Shawn McLoughlin, hearings that are continued to July 15, 2015. One application is from Greg Marciano, owner of CT Coining, that will be heard on July 28, 2015. There is also a pending lawsuit from the applicant to the Planning & Zoning Commission of the Town of Bethel, CT, and CT Coining, whose court date is not yet posted.
Land Use Counsel for the of the Town of Bethel is Attorney Charles R. Andres, Attorney Peter Olsen is representing the crematorium applicant B. Shawn McLoughlin, and Attorney Neil Marcus is representing Greg Marciano, owner of Connecticut Coining, Inc., the property at 10 Trowbridge Drive, located next door to the proposed crematorium site at 12 Trowbridge Drive, in Clarke Business Park in Bethel CT.
The two different special permit applications are for the same crematorium project, and are being considered by the P&Z, from the crematorium applicant B. Shawn McLoughlin, owner of Mono-crete Step Co. LLC, a business located on the same property where he wants to build a crematorium. One application includes a recently revised building plan for a crematorium that has the building split in two, and other revisions, in order to pass zoning regulations, such as distance to a residence in the park. The revised building plan was presented at the June 16, 2015 P&Z meeting and is still to be approved or denied, by the P&Z. The other application is from applicant McLoughlin asking for a “plot of land” approval from the P&Z, for use as a crematorium, and is still pending.
McLoughlin has also placed a lawsuit against the Bethel Planning & Zoning Commission (P&Z) of the Town of Bethel, and Connecticut Coining, Inc., concerning a recently approved text amendment which would not allow a crematorium in Bethel’s IP zone, and a recently approved one-year crematorium moratorium (asked for by Greg Marciano of CT Coining, and approved by the P&Z on May 12, 2015). These two approvals did not affect McLoughlin’s present crematorium applications but the civil lawsuit against the P&Z and CT Coining went forward and is still pending.
According to the Civil Summons in the Superior Court of the State Connecticut, plaintiff B. Shawn McLoughlin is seeking:
“1) The judgement of the Court reversing the decision of the Commission in directing the Commission to deny the Amendment Application and the Moratorium Application;
2) Restraining order staying the Commission’s decision on the Amendment Application and the Moratorium Application pursuant to General statutes §8-8(h);
3) Statutory costs and;
4) Such other relief as in law or equity may apply.”
The return date of the summons was June 23, 2015, and both parties have filed their appearance forms, but records show a court date has not been set yet (as of July 2, 2015)
There is another application to the P&Z from Greg Marciano, owner of CT Coining in Clarke Business Park. His attorney Neil Marcus recently submitted the application to the Bethel Planning & Zoning Commission for a text amendment to delete section 4.3.C.10a to “eliminate crematory facility.” See legal notice here, to be published July 17 and July 24, 2015.
