Montgomery, AL — A 51-year-old man from Montgomery has been arrested and charged with capital murder in connection to the death of a 59-year-old man found on Dexter Avenue earlier this month. Authorities believe the death occurred during the commission of a sexual assault or sodomy.
According to the Montgomery County District Attorney’s Office, the incident took place on Saturday, October 11, when Montgomery police were called to the 100 block of Dexter Avenue after receiving a report of a person being found unresponsive.
“Officers arrived at the scene around 5 a.m. and found a 59-year-old man who was pronounced dead at the scene,” said Lt. Ernestina McGriff, spokesperson for the Montgomery Police Department.
The case is being treated as a homicide investigation.
Arrest and Charges
The following day, on Sunday, October 12, Barry Andre Freeman, 51, was taken into custody and charged with capital murder. He was placed in the Montgomery County Detention Facility.
Court records show Freeman could not be reached for comment, and there is no attorney listed for him.

According to the Montgomery County District Attorney’s Office, investigators believe Freeman made sexual advances toward the 59-year-old man, which were reportedly refused. Afterward, Freeman allegedly punched the victim in the throat and proceeded to sexually assault him while the man was unconscious.
“Freeman’s actions before and after the victim’s death have led to the capital murder charges,” officials said.
The district attorney’s office has not released the identity of the victim, as Montgomery Advertiser typically withholds the names of victims in sex crime cases.
