Crematorium Applicant McLoughlin Asks P&Z for More Time, Clock Is Ticking, Is Applicant Running Out of Time?

The July 23, 2015 closing date for hearing of crematorium application by the P&Z is looming.

Crematorium Applicant McLoughlin Asks P&Z for More Time, Clock Is Ticking, Is Applicant Running Out of Time?

Attorney Peter Olsen, representing B. Shawn McLoughlin, the applicant who wants to have a crematorium approved in Clarke Business Park in Bethel, CT, sent a letter to Patricia A. Rist Chair, Planning & Zoning Commission (P&Z) of the Town of Bethel, on May 21, 2015, asking that the P&Z extend the hearing dates to a later time.  In the letter he states the reasons that he wants the extension, and also states a timeline of days included for past or present extensions.  “The deadline to close the public hearing, should all extensions be granted, would be July 23, 2015,” Olsen states in his letter, “and we are amenable to additional extensions as required.”  So the clock is ticking on this issue.

Dear Pat:

This firm represents the applicants in the above-captioned applications and the owner of the subject property. We hereby request that the Commission continue the continued public hearing scheduled for May 26, 2015 to a special meeting in the week commencing June 15, 2015. The undersigned will be away on vacation the week of June 22, 2015.

The reason that we are requesting this continuance is to allow the applicant to obtain expert reports to respond to the Commission’s questions on two subjects: (a) the effect, or lack thereof, on adjacent properties and properties in the vicinity of the proposed use and (b) the nature and quantity of the emissions, or lack thereof, from the proposed use and the dissipation thereof. Both of these subjects require some time for our experts to prepare reports for the Commission’s review. We are hopeful that we can have them completed in time to present the week of June 15, 2015.

To accommodate this extension, pursuant to Conn. Gen. Stat. § 8-7d (a), we hereby grant an extension of the time to conduct a public hearing of 14 days, through and including June 23, 2015. This extension is calculated as follows:
Public Hearing Opened……..April 14, 2015
Initial Deadline to complete Public Hearing…….May 19, 2015
Initial Extension granted to June 9, 2015…….21 days
Additional Extension granted to June 23, 2015…….14 days
Days remaining for potential extensions…….30 days.

The deadline to close the public hearing, should all extensions be granted, would be July 23, 2015, and we are amenable to additional extensions as required. Should you have any questions, please feel free to give me a call.

The crematorium issue has been going on for over a year now.  The applicant McLoughlin  submitted his first crematorium special permit and building applications in early 2014, then he had to withdraw the applications due to regulation violations with his present business on the same property, Mono-crete Step Co. LLC.  The violations included not having a Certificate of Occupancy for the last 15 years McLoughlin owned and operated that business and McLoughlin had made site modifications to the property that were not in conformance to the original zoning plan.

There are P&Z public hearings planned for May 26, June 9 and June 23, but please note the following, and check P&Z agendas often, to note any changes, as there could be more changes before hearing dates:

“There will be no public hearing on the proposed Crematory at 12 Trowbridge Drive on May 26th.   The applicant has requested a continuance until June 9th and there will be no applicant or public testimony taken on the 26th.  So anyone who was planning to attend the meeting for that application does not need to.  Please reach out to others who you know where planning to attend.  If anyone has question they can contact the Planning & Zoning Department at 794-8578. Thank you and sorry for an inconvenience this may have caused.
