Hurgin Municipal Center, 1 School Street, Bethel, Connecticut, 06801, until 2:00 PM, May 6, 2015 for the following purpose. Eureka Lake Water Storage Tank Said bids will be opened publicly and read aloud at a meeting of the Procurement Committee. Meeting to be held May 6, 2015 at 2:30 PM in Meeting Room A at the Clifford J. Hurgin Municipal Center, 1 School Street, Bethel, Connecticut, 06801. Note that subcontractors contracting to the General Contractor for which their portion of the estimated cost is more than $500,000, must also hold a current Prequalification Certificate for the designated classification (concrete: precast structural and architectural) from the Department of Administrative Services (DAS), and must submit a copy of the contractor’s DAS Prequalification Certificate and Update (Bid) Statement with the bid. The Bid Security may be either a proposal guaranty bond executed by a surety company authorized to do business in the State of Connecticut, or a certified check drawn upon a bank within the State of Connecticut. Bid Security shall be made payable to Town of Bethel, Connecticut. Bids submitted without Bid Security will not be considered. No Bid may be withdrawn for 90 days after receipt of Bids unless released by the Owner. The bid opening will occur at least 30 days from the date of publication of the formal advertisement of the project, pursuant to RCSA Section 22a-482-4(j)2(G). The apparent low bidder must furnish, within 14 days after the receipt of Bids, completed Minority Business Enterprise / Women’s Business Enterprise Subcontractor Verification Forms, provided in the Contract Documents, along with corresponding Minority Business Enterprise (MBE) and Women’s Business Enterprise (WBE) certification for each subcontractor. The requirement for MBE/WBE subcontractor participation, expressed as a percentage of the total contract amount, shall be a minimum of 8.0 percent with the following makeup: MBE 3.0 percent WBE 5.0 percent Failure to meet or exceed the required percentage shall render a bid-non responsive and cause the rejection of the bid. Note: For subcontracts for material suppliers, only 25% of the dollar value of their contracts may be applied toward the required percentage listed above unless that supplier manufactures those supplies. The successful bidder must furnish within 10 calendar days after the Notice of Award the required number of copies of the signed Agreement, 100% Performance Bond, 100% Payment Bond, and begin execution of this contract within 10 calendar days following the Notice to Proceed. Any contract or contracts awarded under the Advertisement to Bid are expected to be funded in part by a loan from the State of Connecticut Drinking Water State Revolving Fund program and in part through a Grant from the State of Connecticut Department of Economic and Community Development. Neither the State of Connecticut nor any of its departments, agencies, or employees is or will be a party to this advertisement or any resulting contract. This procurement is subject to the requirements contained in Section 22a-482-4, (g), (h), (j) and (o) of the Regulations of Connecticut State Agencies. The Successful Bidder must comply with the following: Minority and Women Business Enterprises Requirements: Each Bidder shall take special notice of the Minority and Women Business Enterprise Subcontract Participation in sub-agreements. Failure to complete the requirements of this program may result in finding that the bidder is non-responsive and therefore, not entitled to be awarded this contract. Requirements are detailed in the Bidding Documents. Non-discrimination in Employment and Labor Standards: Bidders on this work and all subcontractors will be required to comply with the Governor’s Executive Order No. 3 and No. 17 regarding affirmative action and equal employment opportunity, as well as provisions in the Civil Rights Act of 1964, Equal Opportunity Act of 1972 and Executive Orders 11246, 11375, 11478. A Compliance Certification Form is required with bid (Section 00406). Requirements under these Orders are detailed in the Bidding Documents. Department of Labor Regulations: The Contractor must comply with all the Safety and Health Regulations (CFR29 Part 1926 and all subsequent amendments) as promulgated by the US Department of Labor on June 24, 1974; the Department of Labor Regulations relating to Copeland “Anti-Kickback Act (18 U.S.C. 874) as supplemented by 29 CFR Part 3; Contract Work Hours and Safety Standards Act (40 U.S.C. 327-330) as supplemented by 29 CFR Part 5, and Occupational Safety and Health Standards (OSHA) (29 CFR Part 1910). Environmental Regulations: In addition to the state regulations cited above, the Contractor must comply with all applicable standards, orders, or requirements issued under Section 306 of the Clean Air Act (42 U.S.C. 1857(h)), Section 508 of the Clean Water Act (33 U.S.C. 1368), Executive Order 11738 and Environmental Protection Agency regulations (40 CFR Part 15). Contractors are urged to become familiar with the requirements of these regulations. Connecticut Department of Labor Prevailing Wages: The Contractor must comply with Section 31-53 of the Connecticut General Statutes as amended, including annual adjustments in Prevailing Wages. State prevailing wage rates are to be paid for a project with an estimated cost greater than $100,000. Federal Department of Labor Davis-Bacon Prevailing Wages: The Contractor must comply with U.S. Department of Labor Davis-Bacon Act, including annual adjustments in Prevailing Wages. The Board of Selectman upon recommendation of the Procurement Committee reserves the right to accept and/or reject any portion of said bid; to waive any technicality in any bid or part thereof and to accept any bid as provided for in Section 8-13c of the Charter of the Town of Bethel.
